Pop icon Madonna is confronting legal action from disgruntled fans, Michael Fellows and Jonathan Hadden, who have filed a lawsuit against the singer for repeatedly commencing her concerts hours behind schedule. The legal action comes in the aftermath of Madonna’s December performances in New York, where her Brooklyn show, slated for an 8:30 pm start, did not commence until 10:30 pm.
Fellows and Hadden, the aggrieved ticket buyers, contend that the singer’s tardiness left them “stranded in the middle of the night” with limited public transportation options. Additionally, the delayed conclusion of the show meant they had to rise early for work or family obligations the following day.
The lawsuit, obtained by TMZ, alleges that Madonna’s actions represent a breach of contract, constituting a “wanton exercise in false advertising, negligent misrepresentation, and unfair and deceptive trade practices.” Fellows and Hadden assert that had they been aware of the delayed start time, they would not have purchased tickets.
A noteworthy claim in the lawsuit is “negligent misrepresentation,” asserting that concert organizers should have been aware, based on alleged prior instances, that Madonna has a history of taking the stage later than advertised. The legal document states, “Defendants’ actions constitute not just a breach of their contracts… but also a wanton exercise in false advertising, negligent misrepresentation, and unfair and deceptive trade practices.”
This legal dispute comes on the heels of earlier criticisms during the first leg of Madonna’s US tour, where technical issues were blamed for a delayed start time of 11 pm instead of the scheduled 8:30 pm. Organizers attributed the delay to technical challenges and clarified that the opening act, DJ Honey Dijon, commenced at the originally specified time. The ongoing legal proceedings underscore the frustrations of fans and the broader issues of timeliness and transparency in the live entertainment industry.
